If that standard is applied to the whole of the legal profession, I am afraid we will be left with only a few lawyers in Mauritius....
Yes, Dev Hurnam is a bit of a loud mouth who tends to ruffle many feathers, including mine. I once commented on a Facebook post of his and he took umbrage when I pointed out a few facts of life about the legal profession and our so called justice system...he was so annoyed that he blocked me, and that was some 3-4 years ago!
But does this mean that I should celebrate how many lawyers have ganged up against him and the legal profession as a whole has decided that there is no way that he should be allowed to resume his professional career and gain his living as a lawyer again? Eoula!
You see, our lawyers seem to share the same DNA as our politicians and will mention God at very opportunity in order to presumably show us how wonderful they really are. Let me remind them of a famous passage in the Bible: " According to the Gospel of John, the Pharisees, in an attempt to discredit Jesus, brought a woman charged with adultery before him. Then they reminded Jesus that adultery was punishable by stoning under Mosaic law and challenged him to judge the woman so that they might then accuse him of disobeying the law. Jesus thought for a moment and then replied, “He that is without sin among you, let him cast the first stone at her.”
The people crowded around him were so touched by their own consciences that they departed. When Jesus found himself alone with the woman, he asked her who were her accusers. She replied, “No man, lord.” Jesus then said, “Neither do I condemn thee: go and sin no more."
Now, we all know, including the lawyers, the Bar Council, the judges, our zourlanus, and all other hypocrites that there are many lawyers, notaries, solicitors, even judges who serve Mammon first, with the interests of justice a long way behind. Nothing else could explain why an inefficient and incompetent system believes it is normal for victims to wait 5, 10, 15, even twenty years before they can see any semblance of justice....assuming the victims have not died in the meantime.
Nothing else could possibly explain why people who willingly want to separate end up having huge fights, with the only beneficiaries being the zavokas of both parties. How can you be happy with a system that sees a young child making serious allegations of sexual abuse having to relive the whole trauma in court some 5 or 10 years after some bastard defiled and desecrated her body? And to then expect her to remember every tawdry detail of the sordid encounter because otherwise the judge will find her testimony lacks credibility?
This is the system that the Attorney General is telling us that we have "toujours une confiance absolue dans la justice"?
Has he ever talked to the victims who see the thieves, muggers, rapists, murderers released on bail, even when many have already admitted their guilt, because to keep them in custody would infringe their "Human Rights"? How can he talk about 'confiance absolue dans la justice" when so many cases of underage sex are treated with utmost leniency and the vast majority of offenders sentenced to balier la cour station for a month or so? Is this how we are going to stop the alarming rise in teenage pregnancy?,
Coming back to Dev Hurnam, the fact is he was found guilty by the Privy Council, albeit on the evidence of one of the thieves. He has served his punishment well over a decade ago. Don't you think that preventing him from doing the only job that he knows for well over 10 years has been a punishment that has amply covered the retribution for his crime?
How much longer should he be punished? Until the day he dies? Haven't they had their pound of flesh? How far will their vindictiveness stretch? Until the pound of flesh turns into a carcass?
I repeat: if the same standards of vindictiveness and callousness are applied to many lawyers and judges, our courts will end up quite empty. Many of you have had your wallets pinched by unscrupulous and incompetent lawyers for a service that was at best crap and at worst useless; many of you have had to walk through the impenetrable labyrinths of our so called justice system, and after years of worries and heartache finally get to see a judgement that may not completely compensate the pain and hardship you have suffered.
Just look at the vast number of people being butchered on our roads and who either end up dead or badly maimed for life. The drunk or careless bastards will be released the next day and allowed to drive for many years before they are found guilty. Do you think our wonderful zavokas and judges are that bothered about your pain and hardship? Why is the inordinately delay in justice running its course considered as 'normal' by them? How come no effort has been made to ensure that some crimes, esp those involving children, are dealt with by the courts as a matter of urgency?
So, why this level of vindictiveness towards Dev Hurnam?
I am afraid his big mouth is partly responsible for that and there is also the nasty, casteeist element. But the main reason is the apparent need of a body of corrupt men and women to provide us with a scapegoat. In their febrile mind, getting rid of Dev Hurnam will show us that we have a truly wonderful legal system with practitioners whose middle names are ''Integrity" and " Honour". Unfortunately, there are not many people who believe this self congratulatory nonsense....
Giving Dev Hurnam back his licence to practise will be a sign that the judiciary is no longer a body of 'special' people safely cloistered in its own little world, but an essential service that serves the interests of the nation. After all, if he fucks up again, he can be dealt with rapidly and efficiently. Dev Hurnam knows this, and it is time to stop treating him like a criminal who ought to be punished for life.
Even murderers are released from their life sentences and can resume their lives again. Why punish someone for life when he served his sentence many, many years ago and has already lost everything? This is nothing but sheer callousness. And our 'Learned Friends" ought to be thoroughly ashamed of themselves!
